Terms and Conditions

Assunta Hospital Mobile Application

These Terms and Conditions (“Terms”) govern your access to and use of the Assunta Hospital Mobile Application (“Platform”). The Platform is a service subscribed to by Assunta Hospital and provided by ENCOREMED® to facilitate patient services. It is not intended to provide medical advice, diagnosis, or treatment. By using this Platform, you agree to comply with these Terms. If you do not agree, please discontinue use immediately.

  • The Platform facilitates the scheduling, rescheduling, and management of appointments with Assunta Hospital healthcare providers.
  • It is designed for the convenience of patients and operational efficiency of the hospital.
  • Any unauthorized or improper use of the Platform is strictly prohibited.
  • Only registered users are permtted to use the Platform. Registration requires providing accurate, complete, and current information.
  • You are responsible for securing the confidentiality of your login credentials.
  • Assunta Hospital reserves the right to suspend or terminate accounts with inaccurate or fraudulent information.
  • Personal data will be processed in compliance with Personal Data Protection Act 2010 (PDPA) and Assunta Hospital’s Data Protection Policy. Full details are available here Assunta Hospital PDPA Policy
  • Data purposes include:
    • Appointment scheduling and related administrative tasks.
    • Service improvement through Internal analysis.
  • Data retention is limited to the time necessary for its intended purpose or as required by law. Secure deletion or anonymization will follow upon expiration of the retention period.
  • Both Assunta Hospital and ENCOREMED® implement industry-standard security measures to protect user data.
  • ENCOREMED® acts as a data processor for this Platform, handling personal data on behalf of Assunta Hospital.
  • By using this Platform, users also agree to ENCOREMED®’s data privacy policies as outlined at ENCOREMED® Terms.
  • You may access, correct, or withdraw your data by contacting ENCOREMED® officer in charge at (insert contact details).
  • The Platform operates 24/7, subject to scheduled maintenance and unexpected disruptions.
  • ENCOREMED® guarantees a 99% uptime, with prior notifications provided for planned outages.
  • Assunta Hospital and ENCOREMED® are not liable for service interruptions caused by factors outside their control.

Users agree to:

Use the Platform only for lawful and authorized purposes.

  • Ensure the accuracy of information entered into the Platform.
  • Notify Assunta Hospital immediately in case of unauthorized access or suspicious activity.
  • Misuse of the Platform, including but not limited to spamming or malicious activities, will result in termination of access.
  • To indemnify and hold harmless Assunta Hospital, ENCOREMED®, and their affiliates from any claims, liabilities, and/or expenses arising from the breach of these Terms or misuse of the Platform.

Assunta Hospital and ENCOREMED® are not responsible for:

  • User errors in appointment scheduling or cancellations.
  • Loss or misuse of login credentials.
  • Indirect, incidental, or consequential damages resulting from Platform use.
  • The Platform is provided “as is,” without any express or implied warranties.

ENCOREMED®’s liability is limited as per their terms of service, which can be accessed at ENCOREMED® Terms

  • The Platform’s content, software, and systems are protected by intellectual property laws and remain the property of Assunta Hospital and ENCOREMED®.
  • Users are prohibited from copying, modifying, or distributing any part of the Platform without prior written consent.
  • Assunta Hospital and ENCOREMED® reserve the right to amend these Terms at any time.
  • Users will be notified of significant changes through the Assunta Hospital website or mobile application at least 30 days before implementation.
  • Continued use of the Platform after changes constitute acceptance of the revised Terms.

Assunta Hospital and/or ENCOREMED® may terminate or suspend user access for:

    • Breach of these Terms.
    • Misuse of the Platform or fraudulent activity.
    • Technical or operational issues requiring account suspension.

These Terms are governed by the laws of Malaysia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of Malaysian courts.
